Apple: iPhone jailbreaking violates our copyright

Summary: Apple has laid out what is believed to be its first legal argument against the practice of jailbreaking an iPhone in response to an EFF petition before the Copyright Office.

Apple recently told the U.S. Copyright Office that it believes iPhone jailbreaking is a violation of the Digital Millennium Copyright Act and infringes on its copyright, according to the Electronic Frontier Foundation.



The EFF is trying to get the Copyright Office to grant a DMCA exemption on behalf of iPhone owners who have chosen to jailbreak their iPhones, or bypass the restriction Apple places on standard iPhones that only allows the installation of applications from approved sources: the App Store. In its response to the Copyright Office , Apple disagreed that such an exemption was proper because the very act of jailbreaking the iPhone results in copyright infringement.

Current jailbreak techniques now in widespread use utilize unauthorized modifications to the copyrighted bootloader and OS, resulting in the infringement of the copyrights in those programs. For example, the current most popular jailbreaking software for the iPhone, PwnageTool (cited by the EFF in its submission) causes a modified bootloader and OS to be installed in the iPhone, resulting in the infringement of Apple's reproduction and derivative works rights.


The EFF's argument is that jailbreaking your iPhone is protected under fair-use doctrines, and that the Copyright Office should grant an exemption because "the culture of tinkering (or hacking, if you prefer) is an important part of our innovation economy." But Apple's response is that few users of jailbroken iPhones actually jailbroke it themselves; instead, they downloaded software created by other parties to make that happen.

Don't expect Apple to come knocking on your door if you're using a jailbroken iPhone; they used a similar argument in the Psystar case and no one has confiscated my Open Computer yet. But Apple could be trying to build momentum behind the recognition of jailbreaking that does more harm than good; already this week, iPhone developers have been discussing writing software that only works on jailed iPhones as a way of preventing application bootlegging.

TRIS Rating Co., Ltd. has affirmed the company and senior debenture ratings of Major Cineplex Group PLC (MAJOR) at “A-” with “stable” outlook. The ratings reflect the company’s leading position in the Thai movie exhibition industry, its prime location properties, and capable management team. These strengths are partially offset by exposure to uncontrollable factors such as the number of films released, film popularity, shortening theatrical release periods prior to the distribution of DVD/VCD (digital versatile disc/video compact disc), competition from other forms of entertainment, and the proliferation of pirated home video products. The “stable” outlook reflects the expectation that MAJOR will be able to maintain its leading market position in the movie exhibition industry and sustain a satisfactory level of performance. Investment opportunities or dividend payments should be prudently considered and should not adversely affect the company’s financial position and liquidity.

The total debt to capitalization ratio decreased from 60.8% in 2009 to 58.3% in 2010 and stood at 52.6% at the end of September of 2011. The company’s liquidity profile is considered satisfactory. Funds from operations (FFO) have been maintained at approximately Bt1,000 million annually since 2005, improving to Bt1,198 million in 2010 and Bt972 million in the first nine months of 2011. The FFO to total debt ratio improved from 14.7% in 2009 to 18.1% in 2010 and 16.8% (non-annualized) in the first nine months of 2011. The EBITDA interest coverage ratio also improved, rising from 2.9 times in 2009 to 4.0 times in 2010 and to 4.6 times in the first nine months of 2011, said TRIS Rating. - End

"Pros" are the primary positive aspects of an idea, process, or thing; "Cons" are the primary negative aspects.

The term "Pros and Cons" means both the primary positive and negative aspects of an idea, process, or thing, and is often used to clarify or decide whether that idea, process, or thing is mainly positive or mainly negative.

For example, when considering to go for a walk, you may look at the "Pros and Cons" of doing so, and decide whether walking is worth your time and effort or not. Some "Pros" might be that walking is a healthy activity that enhances your mental mindset and physical health. Some "Cons" might be that it requires work and you may get sweaty.

Latin phrase pro et contra, 'for and against', and that it has been in use in the abbreviated form since the 16th century. In other words, it is a well established standard usage.
Its like the good things about a subject and a bad bits about the subject...

Pros- good
Cons- bad

Pros are advantages or good things about something, positive aspects, and cons are the negative aspects or disadvantages.

for example:
The pros of logging is that people can get furniture, wood, paper or homes but the cons are that wildlife is killed and forests are destroyed.

disadvantages of information technology


Unemployment - While information technology may have streamlined the business process it has also crated job redundancies, downsizing and outsourcing. This means that a lot of lower and middle level jobs have been done away with causing more people to become unemployed.

Privacy - Though information technology may have made communication quicker, easier and more convenient, it has also bought along privacy issues. From cell phone signal interceptions to email hacking, people are now worried about their once private information becoming public knowledge.

Lack of job security - Industry experts believe that the internet has made job security a big issue as since technology keeps on changing with each day. This means that one has to be in a constant learning mode, if he or she wishes for their job to be secure.

Dominant culture - While information technology may have made the world a global village, it has also contributed to one culture dominating another weaker one. For example it is now argued that US influences how most young teenagers all over the world now act, dress and behave. Languages too have become overshadowed, with English becoming the primary mode of communication for business and everything else.

What are common biases we deal with today? Some bias remarks are very clear like racism, sexism, elitism, favoritism and of course ethnic discrimination. Intelligence, beauty, physical ability and religious biases are all present as well. Bias can also be part of a point of view that includes personal preference, politics, and likes and dislikes. Bias also includes promoting a certain lifestyle or social and cultural status. Most information is biased.


Keep in mind, when looking to see if the news from any media source is biased is a little more difficult. News reporters on television are often biased and many people follow these opinions. Many service providers are reporting on things that may not all be true, because they also get their information based on the bias of others, but this provides for a larger audience.
